Wind Energy Public Comments for the Dec. 13, 2023 State Mineral & Energy Board Meeting

Special Notice regarding Wind Energy

The published notices for comments for DOW LA Gulf Wind in Lafourche-Terrebonne (Docket number OMR 23-03) on Nov. 27th and Cajun Wind in Cameron Parish (Docket number OMR 23-04) on Nov. 29th indicated that comments would be due on the dates of the respective hearings as originally noticed.  While thirty (30) day comment periods associated with public hearings are common in many regulatory processes such as permit applications, there is not such a requirement in the case of the Office of Mineral Resources (OMR) hearings on proposed operating agreements.

However, particularly given this time of year with holidays and travel, OMR has decided to extend both comment periods until Dec. 11th for these proposed agreements. It is our hope that this will strike a balance between giving OMR staff appropriate time to research and compose public comments and allowing the State Mineral and Energy Board the opportunity to consider one (1) or both of the proposals before the year is out. Please note that the public will also have an opportunity to provide further written and oral comment at the Dec. 13th State Mineral and Energy Board hearing.

 Notice Regarding Carbon Sequestration on State Owned Lands

The State, by and through the Louisiana State Mineral and Energy Board (the “Board”) and the Louisiana Department of Wildlife & Fisheries (“LDW&F”), has received inquiries from parties interested in obtaining rights necessary for geologic sequestration of carbon dioxide on portions of certain state owned lands and water bottoms and on lands owned or managed by the Department of Wildlife & Fisheries, situated in Ascension, Assumption, Cameron, Iberville, Jefferson, Livingston, St. Charles, St. James, St. John the Baptist, St. Martin, and Tangipahoa Parishes, Louisiana.

The purpose of this Notice is to ensure public awareness that the Board and LDW&F are currently considering entering into operating agreements in order to grant the rights necessary for geologic sequestration of carbon dioxide as authorized pursuant to La. R.S. 30:209 for portions of the property described herein and to ensure that the State has the best opportunity of being apprised of any other interested parties seeking such storage rights prior to entering into any particular operating agreement in these areas.

Therefore, the Louisiana Office of Mineral Resources is requesting any party interested in obtaining rights necessary for geologic sequestration of carbon dioxide in these areas, or any other area, to please contact Byron Miller of the Office of Mineral Resources at byron.miller@la.gov or 225-342-7121.
